1. Interpretation and Definitions

1.1. Definitions

• Application: Software provided by IvanCoder, downloadable on electronic devices.
• Service: Includes the Application and Website (https://ivancoder.com/).
• User ("You"): Individual or legal entity using the Service.
• Company ("We"): IvanCoder, responsible for the Service.
• Country: Mexico, where we operate.

2. Privacy and Personal Data

2.1. Data Collection

We collect personal data (name, email, phone) for:

• Processing contact requests and quotes.
• Managing projects and related communications.

3. Non-Binding Quotes

Quotes sent via email do not constitute a formal contract and are subject to change until a written agreement is signed.

4. Intellectual Property

4.1. Copyright

• Rights to designs, code and content created by IvanCoder transfer to the client only after full payment.
• Trademarks, logos and intellectual property of IvanCoder are our exclusive property and are not transferred under any circumstances.
• Unauthorized reproduction of quotes, preliminary materials or deliverables is prohibited.
• Any feedback, comments or suggestions provided by users may be used by IvanCoder to improve services without obligation of compensation or acknowledgment.

5. Payment Terms

5.1. Methods and Deadlines

• Accepted methods: Bank transfers (single non-recurring payments).
• Initial deposit: 50% at project start.
• Final payment: 50% upon delivery.
• Non-refundable: Once the project begins, no refunds are accepted.
• Single transaction: All payments correspond to one-time transactions for specific services, without subscriptions or recurring charges.

6. User Responsibilities

The client agrees to:

• Provide truthful information in quotes.
• Respond to feedback requests within reasonable timeframes.

7. Cancellation or Modification

7.1. IvanCoder's Rights

• Reject projects after evaluating quotes.
• Adjust prices if client modifies initial requirements.
• Terminate service for payment breaches.

8. Warranties and Liability Limitation

8.1. Limited Scope

• We don't guarantee specific results (e.g. sales, SEO traffic).
• We exclude liability for indirect damages (lost revenue, delays beyond our control).

9. Formal Hiring Process

1. Approval of quote by client.
2. Contract signing detailing scope, deadlines and costs.
3. Initial payment (50%) to begin work.

10. Jurisdiction and Disputes

• Competent court: Puebla, Mexico.
• Disputes require mandatory mediation before litigation.

11. Prohibited Use of Service

Strictly prohibited:

• Requesting quotes without genuine intent to hire.
• Using our proposals for competitor price comparisons.

12. Age Requirement

The Service is for users 18+ only. By using it, you declare you're of legal age.

13. Force Majeure

We're not responsible for delays or breaches caused by:

• Natural disasters.
• Infrastructure failures (internet/power outages, etc.).

14. Terms Changes

We reserve the right to modify these terms. Significant changes will be notified 30 days in advance.
